Appearance in connection with a request that the board waive or reduce the $2,800 campaign finance late fees assessed against Committee for the Advancement of LA Agriculture; its chairman, John F. Shackelford; and, its treasurer, David Crigler, for its participation in the October 24, 2015 election for the late filing of the 180-P report that was filed 14 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, David Crigler, treasurer, asks that the late fees be waived or reduced because the $2,800 fine would result in the vast majority of the total receipts from the members being forfeited due to an oversight in their office. He states that the Notice of Delinquency was sent to the Chairman, John Shackleford, who is not in the office on a regular basis. The notice was given to Terry Duke for review, but he was out of the office on a business trip until Monday, May 11, 2015. Mr Crigler filed the report immediately after being notified by Mr. Duke on May 11, 2015 that the report was not filed. Corrective measures to avoid a repeat of this mistake has been enacted. Both Terry Duke and Mr. Crigler will now receive notice if any mail is received regarding CALA.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $800 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
