Advisory opinion request from Max Camp regarding whether the Code of Governmental Ethics prohibits Common Ground Health Clinic from signing a lease with the City of New Orleans while he is employed by the city.
Facts:
Max Camp requested an advisory opinion regarding whether the Code prohibits Common Ground Health Clinic from signing a lease with the City of New Orleans while he is employed by the city. Mr. Camp is employed by the City of New Orleans, Department of Property Management, Division of Real Estate. Mr. Camp stated that he is employed as the Division Lease Contract Manager. In this position, his job duties include drafting Grants of Servitude to permit encroachments on or over a public right-of-way (ie. balcony, steps, roof overhangs, etc.). Mr. Camp stated that he has never drafted leases on city-owned buildings or facilities.
Mr. Camp stated that he is a member of the Board of Directors for the Common Ground Health Clinic. He stated that he has served as Chairman since 2013, and he receives no compensation for his service on the board. The Common Ground Health Clinic is a registered non-profit with the State of Louisiana.
Mr. Camp stated that the Common Ground Health Clinic wishes to lease the Arthur Monday Multi-Service Center in Algiers. Mr. Camp provided that he would not participate in any aspect of executing and effectuating the lease of this facility for the board or the city. He stated that the Real Estate Administer drafts the leases for multi-service buildings.

On February 1, 2016, Mr. Camp informed counsel that he resigned from the Common Ground Health Clinic Board on January 30, 2016.


Law:
La. R.S. 42:1113A provides that no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
