RE:
Request that the Board waive the $3,000 and $1,600 late fees assessed against Licensed Professional Counselors PAC; its chairman, Kenneth J. Benedik; and, its treasurer, Gary G. Gintner, Ph.D., in connection with its participation in the October 24, 2015 election, for the following campaign finance disclosure reports: 30-P report that was filed 28 days late and 10-P report that was filed 8 days late.
Facts:
In connection with his request that the Board reduce or waive the late fee assessed for the late filing of the reports, Gary Gintner, Treasurer and Kenneth J. Benedik, Board Chair stated that they did not realize that a 30-P report was due because they did not receive a notice of delinquency for that report. They did, however, receive a notice of delinquency for the 10-P report very soon after the report was due. They state that the reports were filed immediately upon notice that the 10-P report was late and after speaking with someone in the Campaign Finance department.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $800 for the 30-P report based on future compliance.

Suspend all but $500 for the 10-P report based on future compliance. Both late fees must be paid within 30 days or the suspended portion will become due and owing.
