This matter came before the Board at its November meeting during a public hearing. At the conclusion of the public hearing, the majority of the Board voted to issue a declaratory opinion stating that the Campaign Disclosure Act prohibits a person from making, and a candidate from receiving, contributions, prior to the primary election, in excess of the contribution limit for the office being sought. The contribution limits apply on a per election basis, and the time period for making and/or receiving a contribution for the general election begins the day following the primary election. Attached is the declaratory opinion memorializing the Board's determination at the public hearing.
