Waiver request submitted by Allison Rouse Royster, former member of the Louisiana Developmental Disabilities Council, regarding a $1,500 late fee assessed for filing her 2013 Tier 2.1 Annual PFD 203 days late.
Facts:
Ms. Royster states that she thought she had filed the required disclosure statement. In May 2013, she filed a pfd listing the applicable year as "2013." Therefore, she thought she filed her 2013 pfd. However, when you file, you report for the prior calendar year; therefore, her "2013 pfd" filed in May 2013 was accepted as her 2012 pfd as a filer cannot file a 2013 pfd in 2013.

Ms. Royster further states that in addition to the confusion of deadlines and what calendar year a report covers, she had complications with a pregnancy and was unable to attend any of the council meetings. On January 22, 2016, correspondence was sent to Ms. Royster requesting supporting documentation.

Ms. Royster was appointed in March 2013 and she resigned in May 2014.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the disclosure requirements under the Code of Ethics.
