Mr. Cannon requested an opinion regarding the application of La. R.S. 33:441B(1) in determining how to appropriately fill a vacancy in the Tallulah's Mayor Court. Specifically he asked the following questions:
1) How long must the magistrate of the Mayor's Court be unable to serve as a magistrate before the office is considered vacant?
2) What procedure is required to be followed to fill a vacancy in the office of the magistrate of the Mayor's Court?
3) Is it permissible for an assistant district attorney to serve as a court magistrate of the Mayor's Court?
4) Is it permissible for an attorney who provides representation as a public defender to serve as court magistrate of the Mayor's Court?
