Advisory opinion regarding whether the Code of Governmental Ethics (Code) would prohibit St. Tammany Fire Protection District No. 1 (District) from allowing Delgado Community College or Louisiana State University - Eunice to conduct college classes on site at the District and potentially utilize former and/or present District employees as instructors.
Facts:
Mr. Steve Billman, Chief of Training and Safety for the District, requested an advisory opinion regarding whether the Code would prohibit the District from allowing Delgado Community College or Louisiana State University - Eunice to conduct college classes on-site at the District and potentially utilize former and/or present District employees as instructors. Chief Billman provided that the college would hire the instructors and the District would not have any participation in who the college selected. Further, Chief Billman stated that the instructor would not enter into any transactions with the Fire District. He provided that if an employee of the District is selected by a college as an instructor, all courses would be scheduled while that employee is off-duty or on leave from the District. Chief Billman's concern is whether it would present a violation of the Code for an employee to use the District property while preforming compensated services for another entity. The Chief added that the classes would be open to all students who wish to enroll, not just employees of the District.
Recommendations:
Adopt draft advisory opinion.
