Advisory opinion request regarding whether Trojan Storage Mall, a company owned by the daughter of James Cantrelle, Lafourche Parish President, may continue to lease storage units to the Lafourche Parish Council on Aging.
Facts:
Trojan Storage Mall is owned by Jacqueline and Kent Breaux. Ms. Breaux's father, James "Jimmy" Cantrelle was elected to the office of Lafourche Parish President.

The Lafourche Parish Council on Aging (Council), which was created pursuant to a Charter awarded by the Secretary of State, is governed by a Board of Directors, in accordance with La. R.S. 46:1601 et seq.

On May 17, 2006, Charlene Rodriguez executed a contract, on behalf of the Council, for the rental of a storage unit at a rate of $80.00 per month. On or about September 10, 2008, Ms. Rodriguez executed a contract, on behalf of the Council, for the rental of a second storage unit at a rate of $60.00 per month. Sometime shortly thereafter, the Council moved to a different storage unit at a rate of $50.00 per month. These contracts remain in effect until terminated by written notice, or the lessee fails to make payments.

Law:
La. R.S. 42:1113A prohibits a public servant, a member of his immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.
Recommendations:
Adopt the proposed advisory opinion.
