Advisory opinion request regarding whether Gregory Shelden, an employee with the Hammond Water and Sewer Department, may accept employment with The Louisiana Conference on Water Supply, Sewerage, and Industrial Wastes, Inc.
Facts:
Gregory Shelden is currently employed with the Water and Sewer Department of the City of Hammond. His primary job duties involve utility mapping and other administrative duties as assigned by the department head. During his employment with the City, Mr. Shelden has been involved with The Louisiana Conference on Water Supply, Sewerage, and Industrial Wastes, Inc., (Conference) a non-profit organization that promotes professionalism and provides training for water and wastewater operators. Mr. Shelden has served on the Conference's Executive Board as Secretary, Vice-Chair, and Chair-Elect. He has not receive any compensation for serving in those positions.
Law:
La. R.S. 42:1111C(1) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which: (a) Is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated; or (b) Draws substantially upon official data or ideas which have not become part of the body of public information.

La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which he exercises control or owns an interest in excess of twenty-five percent, from receiving any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are neither performed for nor compensated by any person that (1) has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency; (2) conducts operations or activities which are regulated by the public employee's agency; or (3) has substantial economic interests which may be substantially affected by the performance or nonperformance of the public employee's official duty.

Recommendations:
Allow the withdrawal of the request.
