RE:
Request that the Board waive the two $2,000 campaign finance late fees assessed against Vivian Brossett, a candidate for State Representative, District 25 in the October 24, 2015 Election, whose 30-P and 10-P campaign finance disclosure reports were filed 95 and 75 days late, respectively.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Vivian Brossett states that she thought she had submitted the two reports, but for some reason they did not go through. She also stated that she did not raise any money and withdrew from the election due to opposition concerning her residency.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205D provides that an automatic late fee shall be rescinded by staff if the candidate officially withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding the qualifying fee.

Recommendations:
Rescind late fees for the 30-P and 10-P reports based on Rule 1205D.
