RE:
Advisory opinion request regarding whether Sarah Alpough may receive compensation for officiating City of Abbeville Parks and Recreation basketball games.
Facts:
Sarah Alpough is employed by the City of Abbeville as a utility collector within the Utilities Collections Department. Her job duties in this position include accepting payments from City of Abbeville customers for their light and water bills and settling former customer's deposit refunds after their services have been discontinued. She does not perform any work for the City of Abbeville Parks and Recreation Department and she does not have any immediate family members employed by such agency.

She would like to be an official for basketball games for the City of Abbeville Parks and Recreation Department. Officials are paid cash, as an independent contractor, out of the money collected at the door the day of the games. Her officiating would be conducted outside of her working hours for the Utilities Collections Department.

Law:
La. R.S. 42:1113A(1)(a) prohibits a public servant or immediate family member from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed advisory opinion.
Assigned Attorney: Brett Robinson
