RE:
Request that the Board waive the $160, $400 and $880 campaign finance late fees assessed against Rachel Lagarde-Bazile, a candidate for St. Bernard Parish Council, District E in the October 24, 2015 Election, whose 30-P, 10-P and 10-G campaign finance disclosure reports were filed 4, 51 and 22 days late, respectively.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Rachel Lagarde-Bazile states that she was out of town when the 30-P report was due and did not realize she had to file it. She also stated that she faxed the 10-P and 10-G reports timely, but she was having trouble with her phone service at the time and they did not go through.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive for the 30-P and 10-G reports.

Suspend all but $100 based on future compliance for the 10-P report. The late fee must be paid within 30 days or the full amount becomes due and owing.
