Advisory opinion regarding whether Mary Arnold, an employee of the Louisiana Department of Environmental Quality, may pay another employee to take her place when on-call for weekends.
Facts:
Mary Arnold is an employee of the Louisiana Department of Environmental Quality. Part of her job requires her to be a member of the Weekend Emergency Response Team. Once every three months, Ms. Arnold is on-call in case there is an environmental emergency, in which case she is required to respond. The members of the Weekend Emergency Response Team are compensated with K-time equal to the amount of time spent responding to a call. If there are no calls, then team members do not receive any compensation from the department. Ms. Arnold would like to pay another employee to cover her weekends so she does not have to be on-call or respond to an emergency.
Law:
La. R.S. 42:1111A prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt proposed advisory opinion.
