| Advisory opinion request regarding whether Blue Skies Development, LLC (Blue Skies) may sell a parcel of land to the Crowne Parc Joint Commission (Commission) while a nominated member of the Commission has an ownership interest in Blue Skies. |

Harold Forman was nominated to serve as a non-voting member on the Commission on December 3, 2015. The Commission received noticed of his appointment on January 14, 2015 but has yet to formally accept his appointment. Mr. Forman is a ten percent (10%) stockholder of Blue Skies, who is currently in negotiations with the Saint Landry Economic Development (SLED) in a land sale. If an agreement is reached between Blue Skies and SLED, the land underlying the sale will be used by the Commission for an entry or exit option for a multi use equine event center being built.

Crowne Parc Joint Commission was created by an agreement between St. Landry Parish, City of Opelousas, and Harry Guilbeau Area Economic Development District of St. Landry Parish. The Commission has seven voting members and five non-voting members.

La. R.S. 42:1113B provides that no appointed member of any board or commission, member of his immediate family, or legal entity in which he has a substantial economic interest shall bid on or enter into or be in any way interested in any contract, subcontract, or other transactions which is under the supervision or jurisdiction of the agency of such appointed member.
La. R.S. 42:1102(21) defines a substantial economic interest as one in which an economic interest is of greater benefit to the public servant or other person than to a general class or group of persons except the interest that a person has as a member of the general public.
