Reconsideration request in connection with the Board's decision to decline to waive the $1,050 late fee assessed against Colin Blake Miller for failing to timely file a 2015 Supplemental Registration.
Facts:
Initial Consideration:

Mr. Miller states that the final date of lobbying on his application was an inadvertent error on his part. After paying the late fee for failing to submit his August 2015 Legislative lobbyist expenditure report, he proceeded to cancel his lobbying registration for 2015 via the online system. He inaccurately stated the end of his representation of Forum for Equality as late August, 2015, rather than the effective date of September 30, 2015. Mr. Miller sincerely apologizes for the inaccuracy of the reporting and that he registered out of caution and requests the Board to waive or reduce the late fee imposed.



On December 18, 2015 the Board declined to waive the $1,050 late fee assessed against Colin Miller for his failure to timely file a Lobbyist Supplemental Report.



Reconsideration Request:


An affidavit was provided from Christopher Gerald Otten, Esq., who is the Chair of the Board of Directors for the Forum for Equality Louisiana. The affidavit states that Mr. Miller was retained to provide lobbying services on an as-needed basis up to and including September 30, 2015. Mr. Otten also states that he can certify to the accuracy of the contents of Mr. Miller's letter. As stated in Mr. Miller's original waiver request, he selected August 31, 2015 and it was an inadvertent, clerical mistake. His obligations with the Forum for Equality officially ended on September 30, 2015. Mr. Miller has since amended his registration to reflect the termination of his representation of Forum for Equality as September 30, 2015.

Law:
La. R.S. 24:53H Whenever any information contained in his registration changes, or the lobbyist begins representing an additional person, a supplemental electronic registration shall be filed with the board as soon as possible after such change occurs and in any event not later than five days after such change, using forms provided by the board. La. R.S. 24:58D(1) Any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.

Recommendations:
Grant the reconsideration and waive the late fee.
