RE:
Request that the Board waive the $600 and $801 campaign finance late fees assessed against Delaine Theriot, a candidate for Cameron Parish Clerk of Court in the October 24, 2015 Election, whose 30-P and 10-G campaign finance disclosure reports were filed 11 and 70 days late, respectively.
Facts:
In connection with her request that the Board waive the late fees assessed for the late filing of the reports, Delaine Theriot states that she did not understand how to file the reports because this was her first time running for office. She states she was overwhelmed by losing the race and was dealing with the anniversary of the death of her son who died in October seven years ago. The election has depleted her savings and she is living check to check. She relies greatly on credit for purchases for necessities. She has many medical bills from four past hospital visits for surgeries, doctors, pathology labs, and anesthesia. She has been raising her daughter on her own for the past 15 years and her ex-husband is $22,000 in arrears in child support.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive the 30-P report. Suspend all based on future compliance for the 10-G reports.
