Advisory opinion request concerning post-employment restrictions that would apply to Kristyn Childers as a former employee of the Livingston Parish Assessor's Office.
Facts:
In September 2015, Kristyn Childers terminated her employment with the Livingston Parish Assessor's Office to start a private business, Millage Management, LLC, which provides counsel and professional services related to the millage process. Part of Ms. Childers' duties while employed with the Livingston Parish Assessor's Office was to meet with representatives from taxing districts in Livingston Parish and to assist them in accurately and timely meeting all the requirements needed to levy millage for their districts. Millage Management, LLC is currently contracting with taxing districts across the state to provide advice and professional services concerning adoption of millages for ad valorem taxes. Ms. Childers is seeking guidance as to whether Millage Management, LLC may provide this same service to taxing districts in Livingston Parish.
Law:
Section 1121B of the Ethics Code prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction involving the agency of the former public employee, in which the public employee participated at any time during his public employment. Additionally, Section 1121B prohibits a former public employee, for a period of two years following the termination of his public employment, from rendering the same service which he rendered during his public employment on a contractual basis to, for, or on behalf of his former agency. Section 1121C of the Code prohibits any entity in which a former public servant is an officer, director, trustee, partner, or employee for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction or in an appearance in connection with a transaction in which he participated at any time during his public employment and which involves his former public employer.
Recommendations:
Adopt the proposed advisory opinion.
