RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Coastal Impac, and its treasurer, Mr. Toby Gascon in connection with its participation in the October 24, 2015 Election, whose 10-G campaign finance disclosure report was filed 5 days late.
Facts:
In connection with the request that the Board waive the late fee assessed for the late filing of the report, Toby Gascon, treasurer for Coastal Impac, states that he experienced a catastrophic computer crash when he was attempting to file the 10-G report and lost all of the data and the Leaders Program. He states that he worked diligently with IT staff to have the Leaders program installed on the new computer that he purchased. However, they were not successful in getting the Leaders to load on his new computer. He states that he mailed the 10-G report on the due date, but for some reason it was postmarked five days later.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
