RE:
Request that the Board waive the $2,000 campaign finance late fee assessed against Billye Goree Burns, a candidate for State Representative, District 17 in the October 24, 2015 Election, whose 10-G campaign finance disclosure report was filed 98 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Billye Goree Burns states that shortly after she qualified to run for State Representative, she hired Earl Davis to handle all campaign finance reporting associated with her campaign. She states that when she received the late fee notification, she called the Ethics Board to make arrangements to file the report. She states that she has not been able to get in touch with Mr. Davis to find out why he didn't file the report. She also states that she is currently under the care of Glenwood Hospital West Monroe.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 based on future compliance.The late fee must be paid within 30 days or the suspended portion immediately becomes due and owing.
