RE:
Request that the Board waive the $1,320, $120, $60 and $480 campaign finance late fees assessed against Lawrence A. Giambelluca, a candidate for Plaquemines Parish Coroner in the October 24, 2015 election, whose 30-P, 10-P, 10-G and 40-G campaign finance disclosure reports were filed 22, 2, 1, and 8 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Lawrence Giambelluca states that he is 77 years old and throughout the whole election process, he suffered a stroke and a heart attack. He had to have surgery in which 3 stints were placed in his heart. Two weeks after suffering his heart attack, he and his wife were involved in a car wreck and his back was injured. He has undergone steroid injections and is trying to avoid surgery on his spine. Also during this time, Mr. Giambelluca's report preparer was receiving chemotherapy and radiation therapy for throat cancer.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind late fees for the 30-P, 10-P, 10-G and 40-G reports based on Rule 1205B.
