RE:
Advisory opinion request as to whether Landry Deshotel, the elected Police Chief for the Village of Pine Prairie ("Village"), may lease property to a company that does business with the Village.
Facts:
Landry Deshotel is the elected Police Chief for the Village of Pine Prairie ("Village"). The Geo Group owns a prison which is located in the Village and is currently undergoing contract negotiations with the Village regarding the amount of payment it will make to the Village for the housing of inmates. The Police Chief for the Village has no role in housing inmates at the prison owned by the Geo Group. The Geo Group would like to lease property which Chief Deshotel owns for additional parking.
Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant from performing compensated services to a person that has or seeks a business, financial or contractual relationship with the public servant's agency. "Services" is defined in La. R.S. 42:1102(20.1) as the performance of work, duties, or responsibilities, or the leasing, rental or sale of movable or immovable property.
Recommendations:
Adopt the proposed advisory opinion.
