RE:
Advisory opinion request regarding whether Charlotte Turner, a Deputy Clerk with the Tangipahoa Parish Clerk of Court's Office, can perform compensated services for an attorney, after hours at her home.
Facts:
Charlotte Turner is employed as a Deputy Clerk with the Tangipahoa Parish Clerk of Court's Office (Clerk's Office). Ms. Turner serves as the Minute Clerk assigned to Division F of the 21st Judicial District Court, in Tangipahoa Parish (Division F), which handles both civil and criminal matters.

Ms. Turner would be filling out the packets to request expungements on behalf of the clients of Angela Elly. While she is not responsible for processing expungements on behalf of the Clerk's Office, the packets completed by Ms. Turner may be allotted to Division F. Finally, Ms. Elly occasionally represents clients in matters pending in Division F.

Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during her public service unless such services are neither performed for nor compensated by any person from whom she would be prohibited by R.S. 42:1115(A)(1) or (B) from receiving a gift.

La. R.S. 42:1115B(2) prohibits a public employee from soliciting or accepting, directly or indirectly, anything of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public employee knows or reasonably should know that such person has substantial economic interests which may be substantially affected by the performance or nonperformance of her official duty.

Recommendations:
Adopt the proposed advisory opinion.
