Advisory opinion request on behalf of Mr. Bobby Jordan, CEO of Jackson Parish Hospital Service District No. 1 (Jackson Parish Hospital), regarding whether Robin Busby may be employed by the Jackson Parish Hospital while her sister, Amy Magee, is a Jackson Parish Police Juror.
Facts:
Amy Magee was appointed as a Jackson Parish Police Juror in March of 2015. Robin Busby started her employment with Jackson Parish Hospital on July 16, 2015. The Jackson Parish Police Jury appoints members to the Hospital Board but has no other legal authority over the Hospital Board.

La. R.S. 46:1072(2)(a) establishes a "hospital service district" as a political subdivision of the state of Louisiana. La. R.S. 46:1072(6) provides that a "hospital service district commission" means the governing authority or managing board of a hospital service district. The Jackson Parish Hospital District shall be governed by a commission composed of seven members. La. R.S. 46:1053(BB). The district, acting through the board of commissioners, the governing authority thereof may incur debt and issue bonds. La. R.S. 39:559.1B(1). The Hospital Board approves the annual budget for the hospital and the Jackson Parish Police Jury has no review or approval authority over the budget.
Law:
La. R.S. 46:1072(2)(a) establishes a "hospital service district" as a political subdivision of the state of Louisiana.

La. R.S. 46:1072(6) provides that a "hospital service district commission" means the governing authority or managing board of a hospital service district.


La. R.S. 39:559.1B(1) provides that the district, acting through the board of commissioners, the governing authority thereof may incur debt, levy taxes, and issue bonds.


La. R.S. 42:1119B(1) prohibits an immediate family member of a member of the governing authority or the chief executive of a governmental entity from being employed by the governmental entity.

La. R.S. 42:1102(11) provides that a governing authority mean the body which exercises the legislative functions of a political subdivision.

La. R.S. 42:1102(12) provides that a governmental entity is the state or any political subdivision which employs the public employee or employed the former public employee or to which the elected official is elected.
