RE:
Advisory opinion request regarding whether Perceptive Intelligence, LLC (Perceptive), Mark Davis, and Michael Tong may demonstrate the Law Enforcement Network Sharing Solutions (LENSS) product to the leadership of the City of Shreveport Police Department (Department) and Chief Administrative Officer Brian Crawford.
Facts:
Perceptive holds patents on the LENSS, which includes features that could be used by the City Jail and the Long Range Narcotics Investigations Section within the Department. Perceptive employs both Mark Davis and Michael Tong, neither of which has an ownership interest in the company.

Michael Tong retired from the Department on December 31, 2015 as the Commander of the City Jail. He was responsible for overseeing the daily operations of the City Jail and supervised approximately forty (40) employees.

Mark Davis retired from the Department on August 31, 2015, as the supervisor of the Long Range Narcotics Investigations Section within the Narcotics Division. He supervised six (6) officers and corporals assigned to the other Federal Task Forces in the Shreveport area.

Law:
La. R.S. 42:1121A(1) provides that no former agency head shall, for a period of two years following the termination of his public service as the head of such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.

La. R.S. 42:1102(3) provides that "agency head" means the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.


Recommendations:
Adopt proposed advisory opinion.
