Advisory opinion request by Herman Williams, former Interim Lecompte Chief of Police, regarding whether he may be appointed as the Lecompte Chief of Police when his immediate family member is a Lecompte Alderman.
Facts:
The Board previously considered Mr. Williams' issue in Board Docket No. 2012-1612. His daughter, Tamara Williams, is a Lecompte Alderman. He was employed with the Lecompte Police Department for a year and half prior to his daughter being elected as an alderman. He currently serves as Lecompte Interim Chief of Police. He has been serving as Assistant Chief since 2007.The policy and procedure adopted by the Town of Lecompte allows for the Assistant Chief to act as the Chief in the absence of the Chief. He served as Interim Chief on three separate occasions, including from January 1, 2016 to March 7, 2016.


The Board previously determined that the selection of the Police Chief is not a routine promotion within the Police Department as the Lecompte Mayor makes a recommendation of a candidate to the Board of Alderman, who then votes to confirm his appointment.

Law:
42:1119B(1) prohibits a member of an immediate family of a member of a governing authority or the chief executive of a governmental entity from being employed by the governmental entity.

La. R.S. 42:1119C(2) allows for the continued employment and receipt of normal promotional advancements by public employees who have been employed for at least one year prior to the member of the public employee's immediate family becoming an agency head.

Recommendations:
Adopt proposed advisory opinion.
