Advisory opinion request regarding whether Robert Baker, a former employee of the Louisiana State Fire Marshal's Office, may be employed by Brown's Life Safety & Security Co. (Brown) as a security salesperson.
Facts:
Robert Baker retired from the Louisiana State Fire Marshal's Office (Fire Marshal) on November 1, 2014. Prior to his retirement, he was the Captain of the Shreveport District Office where he supervised 15 investigators and inspectors, assigned work assignments, and reviewed work progress and post completion. He also conducted higher level inspections and investigations, such as life safety inspections, code enforcement, and investigations of complaints in regard to building life safety code, fire alarms, sprinkler contractors, and fire extinguisher companies.

The sales position being offered to Mr. Baker by Brown would require him to receive a sales class license through the Fire Marshal's Office. The application would be made through Brown for his licenses. Brown applies for licenses and usually submits fire alarms plans (commercial applications) for review by the plan review section of the Fire Marshal's Office, which must be approved prior to installation. Mr. Baker's sales position would not include handling any fire alarms systems, as those are handled by certified fire alarm plans professionals. The stand-alone security systems that he would sell would not require any submissions to the Fire Marshal's Office.
Law:
La. R.S. 42:1121B(1) provides that no former employee shall, for two years following the termination of his public employment, assist another person for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed or render any service which such former public servant rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
