Advisory opinion request regarding whether a company owned by Michael Levron would be prohibited from providing event production services for events held by non-profit carnival organizations at the Houma-Terrebonne Civic Center, at a time when his father, Al Levron, is employed as the Parish Manager of the Terrebonne Parish Consolidated Government.
Facts:
Al Levron is currently employed as the Parish Manager of the Terrebonne Parish Consolidated Government. As Parish Manager, he supervises the Civic Center Department, which operates the Houma-Terrebonne Civic Center (Civic Center). Non-profit carnival organizations rent the use of the Civic Center, pursuant to a standard form rental agreement.

His son Michael is the owner of Ekim Norvel, LLC, dba Michael Levron Productions (Ekim). Ekim would contract directly with the carnival organizations to provide event production services, including furnishing sound, lighting, staging, and theatrical props, in conjunction with the production of carnival tableaus. There would be no contractual relationship between the Civic Center and Ekim.

Law:
La. R.S. 42:1113A prohibits a public servant, a member of his immediate family, or a legal entity of which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.

La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving his governmental entity in which any member of his immediate family has a substantial economic interest.

Recommendations:
Adopt the proposed advisory opinion.
