Advisory opinion regarding whether Krystle Grindley may accept employment with Caddo Parish as its Parish Information Officer following the termination of employment of her husband, John Grindley, as the Executive Director of CoHabitat Foundation, Inc., a nonprofit that receives grant funding from Caddo Parish.
Facts:
Caddo Parish is operated under a Parish Home Rule Charter that establishes the parish's government as a "commission-administrator" form of government. The Parish Charter provides a clear delineation of governmental functions between the executive and legislative branches of government.

Initially, the parish was requesting an opinion regarding the employment of Krystle Grindley by Caddo Parish as the Parish Information Officer while her husband, John Grindley, serves as the Executive Director of CoHabitat Foundation, Inc., which is a nonprofit that receives grant funding from Caddo Parish. However, since the initial request, there has been a change in facts. The facts now provided state that John Grindley has submitted his resignation to CoHabitat Foundation, Inc. and his last day of service as its Executive Director will be April 30, 2016. The question is whether R.S. 42:1111C(2)(d) will prohibit the employment of Krystle Grindley on May 1, 2016 or after.






Law:
La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are: (d) Neither performed for nor compensated by any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency; conducts operations or activities which are regulated by the public employee's agency; or has substantial economic interests which may be substantially affected by the performance or nonperformance of the public employee's official duty.
Recommendations:
Adopt proposed advisory opinion.
