Appearance by Gerald Burns in connection with an advisory opinion request regarding whether he can participate, as a board member for the Livingston Parish Sewer District No. 1, in matters involving the Sela Gardens Sewer Plant.
Facts:
In July 2014, Gerald Burns and his wife entered into an agreement with Sela Gardens, LLC (Sela Gardens), whereby the Burns granted a servitude through their property to provide access to the property upon which Sela Gardens intends to develop a subdivision. In exchange for allowing a road to be built through their property, Sela Gardens agreed to expand the Sewer Plant by 30,000 gallons of sewer discharge per day, which was dedicated to the Burns. Thereafter, in February 2015, Mr. Burns was appointed to the Livingston Parish Sewer District No. 1 (District) by the Livingston Parish Council. Finally, the District may take over the daily operations of the Sewer Plant, and Mr. Burns will be formally requesting that the District acknowledge and accept the contract with Sela Gardens.
Law:
La. R.S. 42:1113B prohibits an appointed member of any board or commission, member of his immediate family, or legal entity in which he has a substantial economic interest from bidding on or entering into or being in any way interested in any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.
Recommendations:
Adopt the proposed advisory opinion.
