Waiver request submitted by Billy Ray Prince, III, Georgetown Chief of Police - Grant Parish, regarding a $1,500 late fee assessed for filing his 2013 Tier 3 annual PFD 371 days late.
Facts:


Due to the following unique circumstances of this matter, staff would recommend considering the waiver request.

Mr. Prince acknowledges that he received the NOD-FF and that he did not file the PFD within the seven business days allowed. However, he states that he never received the late fee notice or the demand letter. Mr. Prince explains that he and his father share the same name and both live in Georgetown. The Georgetown post office would frequently put his mail in his parent's post office box and his step-mother would at times sign for his mail. Due to the estranged relationship, Mr. Prince would not get all of his mail. He has since changed his mailing address to his rent house in Pineville.

Mr. Prince further explains that he was not made aware of the late fee until he contacted this agency related to a Notice of Delinquency (issued to his new address) related to calendar year 2014. Mr. Prince asks that his waiver request (related to the 2013 annual PFD late fee) be deemed timely.


Mr. Prince also states that he has been taking care of his son since birth, who is now 13 yrs old, except for a 1 year period when he served in Afghanistan. He is now in a custody battle with his son's mother that has cost him $30,000 to date and he cannot afford to pay the $1,500 late fee.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all but $1,000 based on future compliance with the reporting requirements under Code of Ethics and offer a payment plan.
