Advisory opinion regarding whether the post-employment restrictions found in La. R.S. 42:1121A(1) would prohibit Tim Thomas from seeking employment with Greenman-Pedersen, Inc. if he was to terminate his public employment. Mr. Thomas stated that he is currently employed by DOTD as an Engineer 6, in District 61, Gang 216. He stated that as an Engineer 6, he is a supervisor within Gang 216, the Port Allen Project Engineers. Mr. Thomas provided that as an Engineer 6 for Gang 216, he manages the construction projects in West Baton Rouge, Iberville and Pointe Coupee parishes. The projects he manages include bridge and highway construction, surveying activities, contract administration, quality assurance, and material management.
Mr. Thomas would like to seek employment with Greenman-Pedersen to provide construction engineering and inspection services. Greenman-Pedersen does not currently have a contract to work on any projects within District 61 or Gang 216. However, Greenman-Pedersen does have contracts with DOTD to provide services in other districts in the state. Mr. Thomas's new job duties would include construction engineering, inspection services, quality assurance and overseeing project consultants.

La. R.S. 42:1121A(1) prohibits a former agency head or elected official, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving his former agency or rendering any service on a contractual basis to or for such agency.
