Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Ms. Claudette Aubert from serving as CEO of the Greater Grace Charter Academy, Inc (Charter Academy), in St. James Parish, while volunteering her services to New Hope International Family Worship Center (Worship Center). |

The Charter Academy is a type 2 public charter school in St. James Parish. The Charter Academy intends to lease a facility from the Worship Center.
Ms. Claudette Aubert has been employed with the Worship Center as a Pastor for a number of years. Further, he stated that Ms. Aubert was instrumental in preparing the Charter Academy application for approval by the Board of Elementary and Secondary Education. The Charter Academy would like to hire Ms. Aubert to serve as CEO starting in July. You stated that Ms. Aubert would resign as a board member and terminate her employment with the Worship Center prior to accepting employment with the Charter School as the CEO. Additionally, Ms. Aubert's only role at the Worship Center would be as a volunteer, and she would not accept any compensation from the Worship Center.

La. R.S. 42:1123(1) provides an exception for participation in the affairs of charitable, religious, nonprofit education, public service, or civic organizations when no compensation is received.
