Advisory Opinion request from a soon to be retired St. Tammany Parish High School Teacher, Kenneth Matthews, regarding whether the Code of Governmental Ethics would prohibit him from seeking part-time employment with Achieve 3000 after he retires on May 24, 2016.
Facts:
Mr. Matthews provided that Achieve 3000 is a vendor of St. Tammany Parish School System. Achieve 3000 supplies a computer literacy program utilized in the schools. Mr. Matthews is a regular classroom teacher at Fontainebleau High School and has never been in a position to make any decisions regarding with whom the school system contracts. Mr. Matthews would like to be employed by Achieve 3000 as a part-time presenter for teachers. As a part-time presenter, his job would include getting feedback from teachers on how Achieve3000 could improve the software. Mr. Matthews provided that during his public service, he instructed students regarding how to use the Achieve 3000 software, further, Mr. Matthews provided that he never gathered feedback from teachers regarding Achieve 3000.
Law:
La. R.S. 42:1121 B(1) provides that no former public employee shall, for a period of two years following termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt draft advisory opinion.
