Advisory opinion request as to whether LaQuanda Jackson, an employee of the Safe Drinking Water Program within the Louisiana Department of Health and Hospital, may teach food safety classes to members of the public.
Facts:
LaQuanda Jackson was previously employed as a health inspector in the Retail Food Program within the Louisiana Department of Health and Hospitals (DHH). Her job duties as a health inspector were to inspect restaurants for health violations. She is currently employed as a Program Manager in the Safe Drinking Water Program within DHH. Her job duties as a Program Manager involve enforcement as it relates to water systems. Ms. Jackson has never taught food safety classes as part of her public duties with DHH, and if she were to teach food safety classes to the public in the future, she would be paid directly by these individuals.
Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1111E prohibits a public servant or a legal entity of which such public servant is an officer, director, trustee, partner, or employee from receiving any thing of economic value for assisting a person in a transaction with the agency of the public servant.

Recommendations:
Adopt the proposed advisory opinion.
