RE:
Advisory opinion request regarding whether Lorrie Briggs may accept employment with Ekahaya Youth Project (Ekahaya) while she is employed with the Department of Children and Family Services (DCFS).
Facts:
Ms. Briggs is currently employed as a CW manager with DCFS in Lafayette. Ekahaya is an organization that works with Bayou Health System to provide case management services to youths with delinquency issues and their families. The part-time position she was seeking with Ekahaya was parent trainer. This position would not provide case management services but would meet with parents and explain the services Ekahaya offers.
Comments:
The issue is now moot as Ms. Briggs is no longer seeking employment with Ekahaya.
Law:
La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are neither performed for nor compensated by any person from whom such public servant would be prohibited by R.S. 42:1115(A)(1) or (B) from receiving a gift.
