Advisory opinion request as to whether Angelique Williams may become a certified Mental Health Consultant with the Louisiana Department of Health and Hospitals.
Facts:
Angelique Williams is currently employed with the Louisiana Department of Education within the Child Care Licensing Division, which licenses all child care providers in Louisiana. Her job duties include licensing child care centers in the New Orleans and Northshore regions. Ms. Williams would like to work as a Mental Health Consultant with the Louisiana Department of Health and Hospitals (DHH). A Mental Health Consultant's job duties include conducting staff trainings for child care providers, which are paid directly by the child care providers to the Mental Health Consultant. DHH's only involvement would be to certify the Mental Health Consultant and place them on a list of providers.
Law:
La. R.S. 42:1111C(2)(d) generally prohibits a public servant from rendering services for compensation to any person if that person has or is seeking to obtain contractual or other business or financial relationships with the agency of the public servant, if that person is conducting activities or operations regulated by the agency of the public servant or if that person has substantial economic interests that may be substantially affected by the performance or nonperformance of official duties by the public servant.

La. R.S. 42:1102(16) defines "person" as an individual or legal entity other than a governmental entity, or agency thereof.

Recommendations:
Adopt the proposed advisory opinion.
