RE:
Request that the Board waive the $120 campaign finance late fee assessed against Michelle Wilcox, a candidate for Plaquemines Parish Sheriff in the October 24, 2015 election, whose 10-G campaign finance disclosure report was filed 2 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Michelle Wilcox states that her son tried to commit suicide during the time the report was due. He was admitted into the hospital and held for three days and then transferred to another hospital where he remained for some time. Since his release, he has been under the care of a psychologist. She states this has been a very difficult time for her family and asks for compassion from the Board.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Rescind the late fee based on Rule 1205B.
