Advisory opinion regarding whether Dr. Haywood Joiner, Jr., a member of the Rapides Parish Civil Service Board and the Rapides Workforce Development Board may deliberate and vote on matters involving the Workforce Innovation and Opportunity Act.
Facts:
Dr. Haywood Joiner, Jr. was nominated by Louisiana State University at Alexandria and appointed by the Rapides Parish Police Jury to the Rapides Parish Civil Service Board. Dr. Haywood Joiner, Jr. was nominated by the Louisiana State University at Alexandria and appointed by the Rapides Parish Police Jury to the Rapides Workforce Development Board.

The federal programs department is governed by the Rapides Workforce Development Board. The policies and procedures of the federal programs department is governed by the Rapides Parish Civil Service Board. The Workforce Innovation and Opportunity Act (WIOA) is administered by the federal programs department. The WIOA staff are employees of the Rapides Parish Police Jury and covered by civil service.




Law:
La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.
La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.
Recommendations:
Adopt proposed advisory opinion.
