Advisory opinion request by Raymond Hill, II, regarding whether he may enter into a contracts, through his wholly-owned company, Thermo-technics Air Conditioning, Heating and Refrigeration, Inc. (Thermo-technics), with the Shreveport Public Assembly & Recreation Department (SPAR), while his son, Ray Hill, is employed as the Superintendent of Buildings for SPAR.
Facts:
Ray Hill began his employment with SPAR in 2000. He serves as the Superintendent of Buildings for SPAR and supervises the employees who are the building managers and maintenance persons for each of the City of Shreveport's buildings. He is not involved in the bidding of design of projects for SPAR.

Raymond Hill, II, through Thermo-technics, bid on a SPAR project that was open to public bidding. He anticipates bidding on other SPAR projects if it is not a violation of La. R.S. 42:1113.
Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits a public servant, a public servant's immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed advisory opinion.
