Advisory opinion request from Paul Hendricks regarding whether the Code of Governmental Ethics (Code) would prohibit him from entering into a lease with Diamond B Construction Company, LLC, while he is employed by Louisiana State University and assigned to the Louisiana Department of Transportation and Development (DOTD) Research Center.
Facts:
Mr. Hendricks requested an advisory opinion regarding whether the Code would prohibit him from entering into a lease with Diamond B Construction Company, LLC, while he is employed by Louisiana State University and assigned to DOTD as an IT Support Specialist for the Materials and Testing Section 19 of the DOTD Research Center. He provided that prior to April 1, 2016, he was employed by DOTD as an IT Support Specialist for the Materials and Testing Section 22.

Mr. Hendricks stated that Diamond B Construction has a contract with DOTD to replace a public bridge adjacent to his private property. He provided that the bridge project is supervised by the Hammond District 52's engineering gang. Mr. Hendricks stated that he has no prior involvement with the bridge project. He added that Jack Rayburn, the Superintendent with Diamond B Construction, approached him and requested that he enter a lease agreement with them for the use of his property. Diamond B Construction intends to use Mr. Hendricks property to store building supplies, materials, and trailers on while the bridge is under construction.
Law:
La. R.S. 42:1113A provides that no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt draft advisory opinion.
