Advisory opinion request as to whether Anthony J. Alford Insurance Corporation may serve as the agent of record for group insurance benefits for the Terrebonne Parish Consolidated Government.
Facts:
Anthony J. Alford Insurance Corporation (AJAI) submitted an offer to serve as the agent of record for group insurance benefits for the Terrebonne Parish Consolidated Government (TPCG). Gordon E. Dove, Sr. began serving as the Parish President for TPCG on January 7, 2016. Mr. Dove has a business relationship with Anthony Alford in that he and Mr. Alford co-own Paloma Enterprises, Inc. and Alford and Dove Properties, LLC. Mr. Alford also owns 100% of AJAI which writes insurance policies for other business entities owned by Mr. Dove. Should TPCG choose AJAI for its agent of record, Terrebonne Parish Code Section 2-229 requires the terms and conditions of the arrangement to be "contractual and with full ordinance approval of same." A majority vote of the Terrebonne Parish Council is required to approve the ordinance, which must then be presented to the Parish President for approval or veto. Contracts associated with ordinances passed by the Terrebonne Parish Council are signed by the Parish President.
Law:
La. R.S. 42:1113A(1)(a) prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.




Recommendations:
Adopt the proposed advisory opinion.
