RE:
Advisory opinion regarding whether Sandra Franklin, a member of the Rapides Parish School Board, may contract with the Rapides Parish Office of Juvenile Justice Department to conduct parenting classes.
Facts:
Sandra Franklin is a member of the Rapides Parish School Board. Ms. Franklin has been contacted by the Rapides Parish Office of Juvenile Justice to conduct parenting classes. Some of the parents to whom she would be providing these classes have children enrolled in the Rapides Parish School District.

The children are referred from the Child and Welfare Department for truancy. Ms. Franklin will be paid directly from the parents enrolled in her classes, not from the school board or the Juvenile Justice Department. The School Board has no involvement in the referral of children for truancy.


Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.

La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt proposed advisory opinion.
