Advisory opinion regarding whether the St. Tammany Parish Council on Aging may solicit donations from vendors who have contracts with the Council on Aging.
Facts:
The St. Tammany Parish Council on Aging is in the process of putting together a fundraiser and it is seeking to solicit its vendors for significant and material donations for the event. All of the funds received by the vendors from the Council on Aging are public funds. Further, the vendors under contract are required to bid against other vendors for their contracts. The Council on Aging is seeking an opinion on whether it is an impropriety for a vendor who has won a contract to also give a $5,000 donation at a later date for the fundraiser.
Law:
La. R.S. 42:1115A(1) prohibits a public servant from soliciting or accepting, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to have a contractual, business or financial relationship with the public servant's agency.
Recommendations:
Adopt proposed advisory opinion.
