RE:
Advisory opinion regarding whether Ricardo Smith, a former member of the St. Charles Parish Zoning Board of Adjustments, may contract with St. Charles Parish within two years of his termination of service on the St. Charles Parish Zoning Board of Adjustments.
Facts:
In 2009, Ricardo Smith was appointed by the St. Charles Parish Council on nomination by councilman Larry Cochran to the St. Charles Parish Zoning Board of Adjustments. He served until his resignation on January 28, 2016. St. Charles Parish desires to contract with Mr. Smith, through his limited liability company, to perform certain consulting services to include a comprehensive review and analysis of the St. Charles Parish Planning and Zoning Department, pointing out its efficiencies and inefficiencies and making recommendations for the improvement of the department.
Law:
La. R.S. 42:1121A(2) provides that no former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.
Recommendations:
Adopt proposed advisory opinion.
