RE:
Advisory opinion request regarding whether Shane Rauh's post-employment restrictions would prohibit him from working for a private company that would require him to do work with the Governor's Office of Homeland Security and Emergency Preparedness after his employment with GOHSEP ends.
Facts:
Shane Rauh was hired as a grants manager with the Office of Community Development (OCD) Hazard Mitigation Grant Program in January of 2012. His duties while employed by OCD included oversight of the grant in accordance with federal and statutory requirements, quality control, and closeout management involving the final stages of mitigation projects until completion. He supervised employees in regard to preparing documentation on each applicant's file for submission to FEMA to "close-out, complete" that individual grant.



In October of 2015, OCD was dissolved and the remaining employees were absorbed by GOHSEP. The OCD Hazard Mitigation Grant Program officially closed on May 31, 2016.



Law:
La. R.S. 42:1121B(1) provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt proposed advisory opinion request.
