RE:
Request that the Board reconsider waiving the $900, $100 and $2,500 campaign finance late fees assessed against Laleshia Walker-Alford, a candidate for District Attorney, 1st Judicial District Court, in the October 24, 2015 Election, whose 10-P, EDE-P and 10-G campaign finance disclosure reports were filed 9, 1 and 95 days late, respectively.
Facts:
In connection with the request that the Board waive the late fee assessed for the late filing of the report, Laleshia Walker-Alford states that she is experiencing great financial hardship and asks the Board to waive the late fees based on the following:


  • She was laid off from the Public Defender's office on March 4, 2016.
  • The back rooms of her home were flooded on March 28, 2016 and she has significant water damage.
  • On March 30, 2016, she was rear-ended and sustained injuries to her neck, shoulder, and left arm.
  • Her home was burglarized by someone the contractor had allowed to be in her home.
  • She had to obtain office space and office expenses after her home flooded.
  • She has a very large balance for her student loans.
  • She lost her home in foreclosure and filed for bankruptcy in 2008.
  • Her mother has dementia and she is responsible for any expenses not covered by her medical insurance.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Waive the late fees for the 10-P, EDE-P and 10-G reports.
