RE:
Reconsideration of the Board's denial of a waiver request submitted by Wallace J. Landry III, Lakeview Crime Prevention District, regarding a $1,500 late fee assessed for filing his 2013 Tier 2.1 Annual PFD 141 days late.
Facts:
Mr. Landry is requesting reconsideration and an appearance to address the Board regarding his confusion over the NOD and his filing of a report with 2013 listed as the calendar year even though filed in 2013 and counted as his 2012.


Initial Information:

Mr. Landry states that in June 2013 he filed his disclosure statement covering 2013. It should be noted that you cannot file a pfd covering calendar year 2013 in 2013; therefore, any pfd filed in 2013 would be processed as the 2012 pfd.

Mr. Landry stated when he received the Notice of Delinquency (on February 2, 2015) asking for a disclosure statement covering 2013, he thought the notice was issued in error and he did not respond. A review of our database indicates that the disclosure statement filed in June 2013 was processed as a disclosure statement covering calendar year 2012 - as that was the report that was due at that time.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
