Advisory opinion request by William Eckert on behalf of Riverlands Insurance Services (Riverlands) and Julia Fisher Perrier regarding whether Julia Fisher Perrier or Riverlands would be in violation of the Louisiana Code of Governmental Ethics if Ms. Perrier maintains her independent contractor relationship with Riverlands while Riverlands has a contract to provide insurance services to St. Charles Parish.
Facts:
Julia Fisher Perrier is an elected member of the St. Charles Parish Council. She has no ownership interest in Riverlands but receives a commission from them based on the insurance contracts she writes as an independent contractor. Ms. Perrier had no involvement in preparing the Riverlands' bid to act as the insurance agent for St. Charles Parish and she recused herself from any council votes on the matter.
Comments:
The parties have asked that this request be withdrawn and has notified staff that Riverlands is no longer providing insurance for St. Charles Parish.
Law:
La. R.S. 42:1113A(1)(a) provides that no public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Decline to render an advisory opinion.
