Advisory opinion request regarding the application of post-employment restrictions to Andree Pitard, a retired Assistant Attorney General.
Facts:
Andree Pitard retired from the Attorney General's Office on June 4, 2016, after 21 years of public service. As an Assistant Attorney General, Ms. Pitard's duties included representing the State of Louisiana in legal matters involving medical malpractice, road hazards, and general liability. She is interested in continuing to represent the State in legal matters by working with an attorney who is currently contracted with the Attorney General's Office to provide such services. However, Ms. Pitard does not intend to work on cases in which she was previously involved or contract directly with the Attorney General's Office to provide any services.
Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of her public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which she participated at any time during her public employment and involving hers former governmental entity, or for a period of two years following termination of her public employment, rendering any service which she had rendered to the agency during the term of her public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of her former agency.
Recommendations:
Adopt the proposed advisory opinion.
