RE:
Request that the Board waive the six $1,000 ($6,000) campaign finance late fees assessed against Donald "D.T." Thompson, a candidate for Opelousas Chief of Police in the November 4, 2014 Election, whose 30-P, 10-P, 10-G, EDE-G, 40-G and 2015 supplemental campaign finance disclosure reports were filed 497, 476, 446, 728, 474 and 301 days late, respectively.
Facts:
Taylor Bassett, attorney representing Donald Thompson, states that the November 4, 2014 election was Chief Thompson's first election and he did not have prior experience filing campaign finance reports. Chief Thompson hired his sister-in-law to assist him in filing the reports because she has assisted other elected officials in the Opelousas area with their reports. His sister-in-law began undergoing treatment for a serious medical condition and did not inform him that she was not filing the reports correctly. Chief Thompson has since retained a CPA to assist him with amending the reports to accurately reflect all expenditures made.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205D provides that an automatic late fee shall be rescinded by staff if the candidate officially withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding the qualifying fee.

Recommendations:
Decline to waive for the 30-P, 10-P, 10-G, EDE-G, 40-G and 2015 supplemental campaign finance disclosure reports.
